Please read these terms and conditions carefully as these conditions incorporate the basis on which bookings for Australian Luxury Stays are accepted.
ALLREALTY PTY LTD (“ACN: 103 236 380”) trading as Australian Luxury Stays. The terms and conditions below are for bookings made directly via the Australian Luxury Stays website (http://www.australianluxurystays.com.au/) or through the RMS online system.
The terms and conditions of Australian Luxury Stays accommodation, as agreed to by both parties, are as follows:
BOOKINGS AND QUOTES
Bookings can be made over the internet at australianluxurystays.com.au or by calling Australian Luxury Stays on 1300 884 221 if calling from within Australia or +61 8 8232 6388 if calling from overseas.
Reservations are subject to availability and actual pricing at the time of booking.
Verbal quotes are valid for 24 hours only. Any verbal quote given is an estimate only of price, which will be subject to a written advice on confirmation of reservation.
You agree to pay the room rate for each day of your stay and any additional charges up until the time you have departed the accommodation.
The accommodation may be occupied by you only for the period stated on the booking confirmation.
DEPOSIT
A 50% deposit is required to secure and confirm your reservation if booking off-line.
Payment of deposit indicates acceptance of the booking conditions.
FINAL PAYMENT
The balance of payment must be received at least 7 days prior to the arrival date.
For bookings made inside 7 days prior to check-in, full payment is required at time of booking.
Price listed include GST
If deposit or final payment is not received by the due date, Australian Luxury Stays reserves the right to cancel the booking.
SECURITY DEPOSIT
Credit card details will be required at time of reservation and may be used to cover incidental items such as (but not limited to) any breakages or damage incurred during your stay and Cleaning charges in excess of the normal level of cleaning.
Where a credit card is not available a minimum $500.00 cash deposit will be required.
Security Deposit terms cannot be negotiated.
PAYMENT OPTIONS
Payments are accepted by credit cards, Visa or Mastercard only.
Credit card payments incur a 2.5% surcharge.
All payments are only accepted in AUS dollars.
Payments can be accepted via direct deposit.
RATES & CHARGES
Rates quoted are in Australian dollars and are subject to change at any time.
Rates are inclusive of GST where applicable.
Any verbal quote given is an estimate only of price, which will be subject to a written advice on confirmation of the reservation.
Minimum length of stay restrictions may apply to certain rates during special event periods.
The price of your holiday cannot be guaranteed until the deposit is received or if booking online full payment is required.
CANCELLATION TERMS & CHARGES
The following cancellation fees will apply.
If you are able to inform us of your cancellation with more than thirty (30) days notice, your deposit will be refunded less a $50.00 accounting fee.
If notice is provided between thirty (30) days and not less than fifteen (15) days, 25% of the deposit* will be retained.
If less than fourteen (14) days and not less than seven (7) days notice is given, 50% of the deposit* will be retained.
If cancellation notice is provided less than seven (7) days and up to one (1) day prior to the agreed check in date, 100% of the deposit* will be retained.
No cancellations are accepted on the day of arrival or after check in. You will be charged the total of the reserved stay under all circumstances.
Please note: * The deposit is 50% of the agreed tariff on the full stay booked by the client.
Notification must be in writing either facsimile or email and confirmed delivery is the responsibility of the Guest.
CHILDRENS PRICES
In most cases, children’s prices for accommodation are included in the standard tariff rates and refer to children using existing bedding. Additional charges will apply if port-a-cot is required.
Some Australian Luxury Stays properties may not accommodate children. Please check the website or call Australian Luxury Stays for details.
ACCOMMODATION ALLOCATION
In the unlikely event of a situation whereby Australian Luxury Stays cannot provide accommodation as previously confirmed, for whatever reason, Australian Luxury Stays will undertake to relocate clients into an alternative property of equal or better grading at no expense to the client. Should there not be a property of equal or better grading in the vicinity of the original booking, it may be required to provide clients with a property of a lesser grading. If this is the case, any reduction in costs will be refunded to the client.
The alternatives offered are at Australian Luxury Stays discretion. Should the client wish to choose a property of a standard other than that offered under this condition, then the client will be required to pay any difference in price between the Australian Luxury Stays recommended property and their own choice of property.
If Australian Luxury Stays is unable to provide alternative accommodation the accommodation price will be refunded.
NUMBER OF GUESTS
At no time during your occupancy is the number of guests staying to exceed the number booked, unless prior approval is sought and given. Any persons exceeding that number will be considered trespassers and will be evicted.
CHECK IN & CHECK OUT
Your accommodation is available from 3.00 pm on the day of arrival and is to be vacated by 11.00 am on the day of departure. An additional fee will be charged if you do not check out by 11.00 am.
Whilst every effort will be made to accommodate early arrivals and late departures, the only way to absolutely ensure early check-in or late check-out is to book an extra day.
Early arrivals and late check outs are at the discretion of Australian Luxury Stays Management and must be requested at least 1 day prior to arrival or departure.
CLEANING
Extra cleaning and linen change can be arranged for an additional charge, at a cost to you. Contact Australian Luxury Stays Management for further details.
On departure your accommodation is to be left in a clean and tidy state. Extra cleaning charges will apply if this condition is breached and will be deducted from your deposit or credit card.
SMOKING
Smoking inside any Australian Luxury Stays properties is strictly prohibited. If there is any evidence of smoking inside, your booking may be terminated and you will be charged for a specialised clean to eliminate odours.
Please ensure doors and windows are closed if smoking on balconies or in courtyards.
PETS
No pets are permitted. Additional cleaning charges will apply if this condition is breached and deducted from your credit card or deposit.
PERSONAL BELONGINGS
You acknowledge that we do not cover your personal belongings under our insurance policy and therefore take no responsibility for any loss or damage of the occupants personal property left on the premises and agree that you will not make any claim against us for any damages or loss to your personal belongings regardless of how or where the loss or damage occurred.
TRAVEL INSURANCE
We strongly recommend you purchase comprehensive travel insurance at time of booking. We suggest that the policy should include, but not be limited to, the following cover: Loss of deposit through cancellation; loss or damage to personal baggage and loss of money and medical expenses.
BEHAVIOUR
Parties or gatherings are prohibited, unless prior arrangements have been made with Australian Luxury Stays Management. Disturbance to neighbours including excessive noise is prohibited and may result in eviction without refund.
BREAKAGES AND DAMAGES
Your accommodation will be returned to us in the condition presented on arrival.
Damages or breakages of furniture or furnishings must be reported to Australian Luxury Stays Management immediately.
Breakages or damages to the property and all communal or external areas not caused by normal wear and tear, and any excess cleaning required on departure or replacement of items removed from the accommodation will be charged to your credit card, or debited from your refundable deposit.
POOL RULES
All guests using the pools do so at their own risk. You acknowledge that we are not responsible for accidents or injuries. No diving, running or pushing in pool area is allowed.
No glassware allowed in the pool area.
LOCKOUTS & LOSS OF KEYS
Lockouts will incur a standard or after hours call out fee & loss of keys and access fobs will incur a replacement charge.
COMMERCIAL USE
The properties are not to be used for commercial use.
LIABILITIES
You acknowledge that we do not accept liability for any injury, damage, loss, additional expenses and disruptions caused directly or indirectly by events, which are beyond our control and agree not to make any claim in relation thereto.
NO TENANCY
You agree that regardless of your length of stay in there is no tenancy or other rights created under any Landlord and Tenant laws and there are no such laws that apply to your stay.
BREACH OF TERMS AND CONDITIONS
You agree that, should you or your guests breach any of the terms and conditions:
You will pay to us the total loss or damage that we suffer as a result of that breach and hereby authorise us to debit your credit card or apply your refundable deposit in payment of that loss or damage.
We may evict you and your guests without notice
PAYMENT OF DEPOSIT OR FULL PAYMENT CONSTITUTES ACCEPTANCE OF THESE TERMS AND CONDITIONS
