Booking Terms and Conditions


Please read these terms and conditions carefully as these conditions incorporate the basis on which bookings for Australian Luxury Stays are accepted.


A reservation can be terminated at any time if a material term or condition of this agreement is breached. Please read these terms and conditions carefully.


When you make a reservation, these conditions are deemed to have been accepted by ALL GUESTS.

The terms and conditions of Australian Luxury Stays accommodation, as agreed to by both parties, are as follows:


1. BOOKINGS AND PAYMENT

1.1 BOOKINGS AND PAYMENT


Bookings can be made online at www.australianluxurystays.com.au or by calling Australian Luxury Stays on 1300 884 221 if calling from within Australia or +61 406 046 868 if calling from overseas.


1.1.1 BOOKING DETAILS


Reservations are subject to availability and actual pricing at the time of booking.


Verbal quotes are valid for 24 hours only. Any verbal quote given is an estimate only of price, which will be subject to a written advice on confirmation of booking.


You agree to pay the rate for each night of your stay and any additional charges up until the time you have departed the accommodation.

The accommodation may be occupied only by the stipulated number of guests for the period stated on the booking confirmation.


To book accommodation you must be aged 25 years and over. Photo ID may be required. If no photo ID is produced Australian Luxury Stays reserves the right to cancel the booking and is under no obligation to refund any payment related to the booking.


1.2 DEPOSIT


A 51% deposit is required to secure and confirm your booking and must be paid within 24 hours.


Payment of deposit indicates acceptance of the booking Terms & Conditions.


1.2.1 FINAL PAYMENT


The balance of payment must be received at least 30 days prior to the arrival date (or as indicated in your booking details).


For bookings made inside 30 days prior to arrival/check-in, full payment is required at time of booking.


If deposit or final payment is not received by the due date (30 days before arrival), Australian Luxury Stays reserves the right to cancel the booking.


1.2.2. SECURITY DEPOSIT


Two options may be used:


1. A refundable deposit (from $700) per stay which may be used to cover incidental items such as (but not limited to) any breakages, damage or losses incurred during your stay and cleaning charges in excess of the normal level of cleaning.

 

OR

 

2. Credit card details required at time of booking which may be used to cover incidental items such as (but not limited to) any breakages, damage or losses incurred during your stay and cleaning charges in excess of the normal level of cleaning. Pre-authorisation hold will be in place the day before arrival and will be released after 7 days.


Any claims will be automatically deducted from the refundable deposit or credit card and you will be notified at the time.

If the claim is not at fault to the registered guest/occupant, it is the registered guest/occupant’s responsibility to retrieve funds from other parties involved.


Credit card details will be destroyed after the departure clean and inspection of the property, if no claims are to be made.

For longer lengths of stays a security deposit ranging from 2 to 4 weeks based on the weekly rate will be required. If there are no breakages, loss or excessive cleaning the security deposit will be released in full 7-10 days after departure.


1.2.3. PAYMENT OPTIONS


  • Payments are accepted by electronic funds transfer (EFT) or credit cards, Visa or MasterCard only.
  • Credit card payments incur a variable surcharge.
  • EFT fund transfers do not incur a surcharge.
  • All payments are only accepted in AUS dollars.
  • A credit card service fee and administrative fee will apply which is non-refundable


1.2.4. RATES & CHARGES


Rates quoted are in Australian dollars and are subject to change at any time.

GST is not applicable.


Any verbal quote given is an estimate only of price, which will be subject to a written advice on confirmation of the booking.


Minimum length of stay restrictions may apply to certain rates during special event periods, for example Easter (4 nights) & long weekends (3 nights).


The price of your accommodation cannot be guaranteed until the deposit is received or if booking online full payment is required.

A Booking Fee of $75 is applied upon confirmation of each booking.

 

And administration and processing fee of 5% of the total accommodation fare and cleaning fee.

 

2. CANCELLATION TERMS & CHARGES


The following cancellation fees will apply.


If a guest cancels or modifies a confirmed booking sixty (60) days or more prior to commencement of the stay, the deposit will be returned less a $75 GST inclusive administration fee. Note the initial booking fee is non-refundable.


If the guest cancels or modifies their stay within sixty (60) days prior to the commencement of the stay 50% of the entire booking will be retained plus a $75 GST inclusive administration fee. Note the initial booking fee is non-refundable.


If the cancellation or modification is less than thirty days (30) days prior to the agreed check in date, 100% of the entire booking tariff will be retained unless the accommodation is re-booked for the total period of the occupancy and is to the same monetary value.


If the accommodation is re-booked for the same monetary value the entire booking tariff will be refunded less a $75 GST inclusive administration fee. Note the initial booking fee is non-refundable.


If the accommodation is re-booked and is of less monetary value than the original booking the refund will be calculated on the basis of the difference less a $75 GST inclusive administration fee. The initial booking fee is non-refundable.


Notification for the cancellation must be in writing via email and confirmed delivery is the responsibility of the guest.


Under extenuating circumstances refunds will be assessed on a case by case basis.


3. CHILDREN’S PRICES


In most cases, children’s prices for accommodation are included in the standard tariff rates and refer to children using existing bedding. Additional charges will apply if port-a-cot is required.


Some Australian Luxury Stays properties may not be suitable for children. Please check the website or call Australian Luxury Stays for details.


4. ACCOMMODATION ALLOCATION


In the unlikely event of a situation whereby Australian Luxury Stays cannot provide accommodation as previously confirmed, for whatever reason, Australian Luxury Stays will undertake to relocate guests into an alternative property of equal or better grading at no expense to the guest. Should there not be a property of equal or better grading in the vicinity of the original booking, it may be required to provide guests with a property of a lesser grading. If this is the case, any reduction in costs will be refunded to the guest.


The alternatives offered are at Australian Luxury Stays discretion. Should the guest wish to choose a property of a standard other than that offered under this condition, then the guest will be required to pay any difference in price between the Australian Luxury Stays recommended property and their own choice of property.


If Australian Luxury Stays is unable to provide alternative accommodation the cost of the accommodation will be refunded, less a $75 +GST administration fee + credit card services fees.


5. GUEST INFORMATION & OBLIGATIONS

5.1. NUMBER OF GUESTS


At no time during your occupancy is the number of guests staying to exceed the number booked, unless prior approval is sought and given. The use of extra beds other than the number booked will attract an additional tariff. Any persons exceeding the maximum occupancy of the property will be considered trespassers and will be evicted.


5.2. CHECK IN & CHECK OUT


Your accommodation is available from 3.00 pm on the day of arrival and is to be vacated by 11.00 am on the day of departure. An additional fee will be charged if you do not check out by 11.00 am.


Whilst every effort will be made to accommodate early arrivals and late departures, the only way to ensure early check-in or late check-out is to book an extra night. Check out time adjustments may be possible on a case by case basis and at an additional cost.


Early arrivals and late check outs are at the discretion of Australian Luxury Stays Management and must be requested at the time of booking and can only be confirmed 1 day prior to arrival or departure.


5.3. CLEANING


Extra cleaning and linen change can be arranged for an additional charge, at a cost to you. Contact Australian Luxury Stays Management for further details.


On departure your accommodation is to be left in a clean and tidy state. Extra cleaning charges will apply if this condition is breached and will be charged to the refundable deposit or credit card on file at a rate of $65 per hour. The cost of a standard clean, which varies from property to property, is included in your payment at time of booking. 


Barbeques that are not cleaned by the guest on departure, attract a fee of $150 to your refundable deposit or charged to a credit card. 


5.4. LINEN


All properties are fully self-contained which includes linen (sheets, pillow cases, towels & tea towels) unless specified otherwise.

A replacement cost of $50 will be incurred for any linen that is permanently stained by, but not limited to, hair dye, bleach, fake tan, permanent ink.


5.5. SMOKING


Smoking inside any Australian Luxury Stays properties is strictly prohibited. If there is any evidence of smoking inside, your booking may be terminated and you will be charged for a specialised clean to eliminate odours. You may also be charged a fine.


Where permitted, please ensure doors and windows are closed if smoking on balconies or in courtyards.


5.6. RUBBISH


The disposal of rubbish, general waste or recycling is explained in the guest information provided prior to arrival There are specific instructions per property and where bins are provided for council collection, the collection day and time is clearly documented. Guests who fail to place bins on the kerbside on the collection day or leave excess rubbish on departure will be charged a fee to cover the cost of a private contractor to dispose of the rubbish.


5.7. PETS


No pets are permitted without the prior consent and written approval of Australian Luxury Stays If unapproved pets are found on the property, the booking will be terminated and guests will be asked to vacate with no refund.


In relation to ‘Pet friendly’ accommodation, you will need to bring the pets own bedding. Pets are not allowed on furniture or beds.


Unruly or loud (barking) behaviour will not be tolerated. If your pet becomes bothersome to neighbours, for example a dog barking continually when left unattended, you will be contacted to return to the property to remedy the situation and if complaints continue this may result in termination of the booking and loss of unused balance of accommodation.


All pet waste must be removed and disposed of appropriately. If this does not occur a cleaning fee ($250) will be charged to the guest. Any pest control required as a result of a pet inside and/or on the property will be charged to the guest.


5.8. PERSONAL BELONGINGS


You acknowledge that we do not cover your personal belongings under our insurance policy and therefore take no responsibility for any loss or damage of the occupants’ personal property left on the property and agree that you will not make any claim against us for any damages or loss to your personal belongings regardless of how or where the loss or damage occurred. Ensure locking the premises and vehicles when not attended.


There is an administration charge (based on time) to collect items that have been left behind in properties and payment of postage or courier is the guests’ responsibility. Lost property that is not collected within 2 weeks will be donated to a charitable organisation.


5.9. TRAVEL INSURANCE


We strongly recommend you purchase comprehensive travel insurance at the time of booking. We suggest that the policy should include, but not be limited to, the reimbursement of any monies paid in the event the travel is cancelled; loss or damage to personal baggage and loss of money and cover for medical expenses.


5.10. GOOD NEIGHBOUR POLICY


Parties or gatherings are prohibited, unless prior arrangements have been made with Australian Luxury Stays Management. Disturbance to neighbours including excessive noise is prohibited and may result in eviction without refund. Ensure that noise levels are kept to a minimum from 10pm until 8am the next morning.


The property is a privately-owned home, and we enforce a “Good Neighbour Policy”. Please treat the property with the same care you would use with your own residence and leave it the same condition it was in when you arrived.


5.11. BREAKAGES AND DAMAGES


  • Your accommodation will be returned to us in the condition presented on arrival.
  • Damages or breakages of furniture or furnishings must be reported to Australian Luxury Stays Management immediately.
  • Breakages or damages to the property and all communal or external areas that are caused by any guest and/or a guest’s visitor will be charged and recouped in full from the guest’s security deposit or credit card.
  • Excess cleaning required on departure or replacement of items removed from the accommodation will be charged to the guest’s credit card, or deducted from the guest’s refundable deposit.
  • Furniture, fixtures and fittings are not to be altered or moved between rooms or properties. There will be a charge incurred if furniture is not returned to its original location.
  • ALS must be informed of any problem or complaint as soon as possible as to rectify the situation as quickly and as efficiently as possible. You must allow access to the property for service consultants to undertake repairs during reasonable hours. We will notify you and confirm the day, date and time of the appointment. We will arrange access if you are not available at the designated time.


5.12. POOL RULES


All guests using a pool do so at their own risk. You acknowledge that we are not responsible for accidents or injuries. No diving, running or pushing in a pool area is allowed.


No glassware allowed in a pool area.


5.13. COMMERCIAL USE


The properties are not to be used for commercial use.

Tents, caravans and other structures are not be erected or occupied at the property at any time, including inflatable pools.


5.14. LIABILITIES


You acknowledge that we do not accept liability for any injury, damage, loss, additional expenses and disruptions caused directly or indirectly by events, which are beyond our control and agree not to make any claim in relation thereto.


5.15. NO TENANCY


You agree that regardless of your length of stay there is no tenancy or other rights created under any Landlord and Tenant laws and there are no such laws that apply to your stay.

 

5.16. TERMS AND CONDITIONS BETWEEN OWNERS & GUESTS

 

The Terms and Conditions, upon which a property is offered, booked and occupied for holiday rental under the contract between the Owner and Guest, is consistent with the requirements of the Short -Term Rental Code of Conduct. Australian Luxury Stays is a member of the Australian Short-Term Rental Association and is bound by the Short-Term Code of Conduct and House Rules which apply to the holiday rental industry throughout Australia.


5.17. BREACH OF TERMS AND CONDITIONS


You agree that, should you or your guests breach any of the terms and conditions:


  1. You will pay to us the total loss or damage that we suffer as a result of that breach and hereby authorise us to debit your security deposit/credit card as payment of that loss or damage.
  2. We may evict you and your guests without notice


Payment of deposit or full payment constitutes acceptance of these terms and conditions. The terms and conditions of booking are subject to change without notice.
